General terms and conditions of Lake Baikal Adventure
As of 02 / 2021
Travel registration, travel contract
- The traveler's binding travel registration is the basis for
concluding a travel contract.
- The travel contract is concluded with the written travel
confirmation sent to the traveler by Lake Baikal Adventure (LBA).
- If the content of the travel confirmation differs from the
content of the registration, LBA is bound to this new offer for 10
days. If the traveler does not refuse this new offer in writing
within 10 days, the contract will be concluded on the basis of
this new offer.
Deposit, final payment
- After receiving the registration confirmation, a deposit of
500€, 600USD or 4000 Yuan must be paid
- If the deposit is not paid on time, LBA is entitled to terminate
the contract after a one-time reminder and to demand travel
cancellation costs in accordance with Section 2 as compensation.
Performance, price adjustment
- The type and scope of the contractual services result from the
content of the service description from the related information in
the travel confirmation.
- Service providers (e.g. airlines, hotels, camps, etc.) and
travel agencies are not authorized by AS to make agreements with
travelers that go beyond or contradict LBA's travel confirmation.
- In the event of price increases of more than 5%, the traveler is
entitled to withdraw from the travel contract without any
cancellation fees. The traveler must assert this right immediately
after LBA notifies LBA of the price increase.
Cancellation by the traveler, rebooking
- The traveler can withdraw from the travel contract by making a
written declaration before the start of the trip.
- However, the traveler must pay LBA compensation for the costs
incurred by the travel preparations made. These are generalized as
follows:
- Up to 90 days before departure €250 of the travel price
- Up to 30 days before departure €300 of the travel price
- 15 days to 0 days before departure €500 of the travel price
- For rebookings (e.g. changes to travel dates) that are made at
the traveler's request after the travel has been confirmed, a flat
rate fee of 25 euros per person will be charged, provided this can
be implemented. Otherwise flat-rate cancellation fees apply for
new registrations.
- If the traveler takes part due to illness, etc. If individual
travel services are not used in circumstances for which LBA is not
responsible, there is no entitlement to a pro-rata refund of the
travel price. Unless individual expenses are actually reimbursed
to LBA by the service providers.
- If the trip is significantly impaired as a result of a travel
defect and no remedy has been provided within a reasonable period
of time or a remedy is not possible, the traveler can terminate
the contract. However, the traveler is obliged to immediately
report his complaints in writing to the local tour guide. If the
traveler culpably fails to report a defect, there is no
entitlement to a reduction.
